These Terms and Conditions apply to the BitPrism (EMU GB/A/C) application for mobile devices, together with any related services operated by Benjamin Kararic under B-ee (Butterfly-Effect Enterprise) (collectively, the "Application"). Benjamin Kararic is hereby referred to as the "Service Provider".
By downloading, installing, or using the Application, you agree to these Terms and Conditions. Please read them carefully before using the Application.
1. Emulator Disclaimer, No ROMs Included & Non-Affiliation
No Game ROMs or BIOS Files Included: BitPrism is strictly a hardware emulation tool and does not bundle, distribute, host, or link to any copyrighted game ROMs, BIOS files, or third-party game software. Users are solely responsible for supplying their own legally obtained game backups or homebrew software in compliance with applicable copyright laws in their jurisdiction.
Trademark Non-Affiliation: BitPrism and B-ee (Butterfly-Effect Enterprise) are independent and are not affiliated with, endorsed by, authorized by, or associated with Nintendo Co., Ltd. or any other console manufacturer. References to "Game Boy", "Game Boy Color", "Game Boy Advance", or related abbreviations ("GB", "GBC", "GBA") are used strictly for descriptive compatibility purposes.
2. License to Use the Application
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a compatible mobile device for personal, non-commercial use. Except to the extent expressly permitted by applicable law or open-source component licenses, you may not reproduce, distribute, modify, reverse engineer, decompile, or disassemble the proprietary portions of the Application.
3. Intellectual Property
The Service Provider retains all intellectual property rights in the Application's original code, user interface design, trademarks, service marks, trade names, logos, and branding (including the "BitPrism" and "B-ee" marks). You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed in or on the Application.
4. Acceptable Use & User Responsibility
When using the Application, you agree that you will not:
- Use the Application to infringe the intellectual property or copyright rights of any third party;
- Distribute pirated or unauthorized copyrighted ROM images in connection with the Application;
- Attempt to bypass, disable, or tamper with security, age-gating, or fair-ad delivery mechanisms in the Application;
- Use the Application for any unlawful, fraudulent, or malicious activity.
5. Eligibility and Age Restrictions
By accessing and using this Application, you represent that you are legally permitted to use it in your jurisdiction. You must be at least 16 years of age (or the applicable age of digital consent in your jurisdiction) to use the Application independently. If you are under 16, a parent or legal guardian must review and accept these Terms on your behalf.
6. Termination
The Service Provider may suspend or terminate your right to use the Application if you materially breach these Terms. Upon termination, the license granted to you under these Terms will immediately end, and you must cease using and delete the Application from your devices.
7. Security & Device Integrity
It is your responsibility to maintain the security of your mobile device and local files. The Service Provider strongly advises against jailbreaking or rooting your mobile device, which removes official operating system security restrictions and may expose your device to malware or cause the Application to malfunction.
8. Third-Party Services & Data Charges
The Application integrates third-party services that operate under their own Terms and Conditions:
Certain features (such as ad delivery or updates) require an active internet connection. You are solely responsible for any mobile carrier data or roaming charges incurred while using the Application outside of a Wi-Fi network.
9. Limitation of Liability
To the fullest extent permitted by applicable law, the Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including any warranty against loss of local save states or in-game progress. The Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under mandatory consumer protection law. To the fullest extent permitted by law, total liability for any claim shall not exceed the amount paid by you for the Application in the 12 months preceding the claim.
10. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless the Service Provider from and against any claims, liabilities, damages, losses, and reasonable legal expenses arising out of your breach of these Terms or your unlawful use of third-party files within the Application.
11. DSA Compliance (Digital Services Act)
To the extent applicable under the EU Digital Services Act (Regulation (EU) 2022/2065, "DSA"), the Service Provider maintains a single point of contact for EU authorities and users at benet255@gmail.com. Any notices or inquiries sent to this address will be reviewed promptly and in good faith.
12. Governing Law, Severability & Updates
These Terms and Conditions are governed by the laws of the jurisdiction in which the Service Provider is established, without prejudice to mandatory consumer protection laws in your country of residence. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The Service Provider may update the Application or these Terms periodically. Continued use of the Application after changes are posted constitutes acceptance of the revised Terms.
